§3. Offer
3.1. At www.medina-med.com we sell only new tires, not older than 36 months from the date of manufacture, unless the Client is informed otherwise (promotions of warehouse stock, clearance sales, etc.).
3.2. All goods sold in the Store are NEW, free from physical and legal defects, full-value, and have a full manufacturer's warranty for a period of 24 months.
3.3. According to the practice of most manufacturers, new tires are considered those not used and not older than 60 months from the date of manufacture. Responding to the constantly growing requirements of our clients, the Store has shortened this period to 36 months and continues to work towards shortening this period!
3.4. In special cases, where this is expressly noted in the name and description of the product, in the sub-page "Clearance", "DOT Promotion", "Promotion" or elsewhere determined by Medina Med Ltd., tires older than 36 months and/or tires discontinued from the production process by the manufacturer may be offered.
3.5. Any information related to the goods, including leaflets, brochures, and other informational or advertising materials, and furthermore information included on the Store's pages and addressed by Medina Med Ltd. to Recipients and potential Clients does not constitute an offer within the meaning of the law, but solely an invitation to start negotiations.
3.6. The price list presented on the Store's pages does not constitute a commercial offer within the meaning of the Obligations and Contracts Act, but represents solely an invitation to start negotiations (Art. 13, Para. 1 of the OCA).
§4. Prices of Goods
4.1. All prices published on the pages of the Medina Med Ltd. Store are indicated in Euro (€/EUR) and in Bulgarian Leva (BGN) and include VAT at the rate of 20% according to Bulgarian legislation (gross prices).
4.2. The dual display of prices of goods and services in Euro and in Leva ends no earlier than 12 months after the date of introduction of the Euro in the Republic of Bulgaria. After this date, all prices will be indicated only in Euro, according to the Law on the Introduction of the Euro in Bulgaria.
4.3. The conversion from Leva to Euro is performed by dividing the numerical value in Leva by the full numerical value of the official exchange rate, expressed with six digits with all five signs after the decimal point. The official exchange rate is not rounded or shortened when performing the conversion.
4.4. After the conversion, the resulting amount is rounded to the second decimal place based on the third decimal place in accordance with the following mathematical rounding rule: - when the third decimal place is less than five, the second decimal place remains unchanged; - when the third decimal place is equal to or greater than five, the second decimal place is increased by one unit.
4.5. The final price indicated next to the item is valid at the moment of submitting the purchase request by the Client.
4.6. The Client pays the delivery costs, the exact amount of which is calculated automatically by the system when creating an order.
-
DOT Promotion - Price reduction of products from the final price, relative to the DOT code of the tire. The DOT code is a marking on the tire containing specific information about the production of that tire, where and when it was manufactured. For the end customer, the most significant information from the DOT code is the year of manufacture. These are four digits, usually enclosed in an oval, but not necessarily. The first two show the week of manufacture, and the next two - the year. For example, a tire with DOT NEDV JA2R 4916 was manufactured in the 49th week of 2016. (IMPORTANT! The year of manufacture is not related to the aging of the tire, nor to its shelf life).
-
Promotion - Price reduction of products from the final price due to tires discontinued from the production process - stopped from production by the manufacturer and/or tires with a DOT code equal to and/or older than 36 months from the date of manufacture.
-
Trade Discount - by virtue of an agreement or written contract with corporate clients and business partners and subject to the conditions provided therein, Medina Med Ltd. provides an additional trade discount from the indicated final price to employees, cardholders, and other entitled persons.
IMPORTANT! The indicated price advantages (promotions, campaigns, discounts, and reductions of any kind) cannot be combined with each other, nor with other discounts, promotions, or price reductions. The most favorable price for the client is applied.
§5. Orders
5.1. The Medina Med Ltd. Store accepts orders in three ways: via the Internet page available at www.medina-med.com, via e-mail, or by phone. During the winter season (the months of September, October, November, and December), ordering by phone may be refused due to the heavy workload of operators.
5.1.1. Orders in the Internet Store medina-med.com can be submitted 24 hours a day, 7 days a week through the Internet page. For the correct submission of a request, it is necessary for the client to have their own email address and contact phone number. This is the simplest, fastest, and most accurate way to submit a request. The order for delivery of the selected item can be submitted by adding the item to the cart and filling out the respective registration form or quick order without registration.
The order via the Store's Internet page consists of the following main stages:
-
Selection of goods from those presented on the Store's page;
-
Placing the selected products in the cart;
-
Filling out a form with invoice and delivery data and available registration option;
-
Acceptance of the general terms of sale;
-
Giving freely expressed, specific, informed, and unambiguous consent for the purposes and term of processing of the provided personal data;
-
Selection of payment method;
-
Final summary screen of the selected products and filled data, where the order is completed by pressing the "Confirm Order" button.
In response to the submitted delivery request, the Store medina-med.com automatically sends an electronic copy of the order made by the Client. This represents confirmation that the delivery request made by the Client has automatically been given a number. After that, within 48 hours,
The Store sends a message to the email address provided by the Client or contacts them in another way for the purpose of:
A. confirmation of acceptance of the order – in this case, the sales contract is concluded on the day of confirmation, B. refusal to accept the order – in such a case, a contract is not concluded. C. proposal for change, presentation of a so-called counter-offer – in such a case, confirmation (approval) of the counter-offer by the Client is necessary for concluding a contract.
During the winter season (increased interest in purchasing tires in the period from September to the end of the year) and the summer season, delivery times to the client may be extended. Nevertheless, regarding the Client, the order realization time will not exceed 5 working days.
5.1.2. Orders by phone. In the hours from 9:30 to 18:00 on weekdays, and on Saturdays from 9:30 to 14:00, the Store provides its Clients with a connection to an operator who provides information, assistance, and accepts orders. The Client may submit a purchase request by phone as well. During the conversation with the consultant, the Client must submit all necessary data for the correct flow of the ordering process – exact characteristics of the goods, full name, exact address, and contact phone, as well as freely expressed, specific, informed, and unambiguous consent for the processing of the provided personal data. Besides the listed data, a tax number must additionally be submitted (this concerns solely business entities purchasing goods or individuals practicing liberal professions and serves for the correct issuance of a VAT invoice). For the purpose of improving service, as well as for resolving disputes between parties, conversations may be recorded. Records are kept for a period of up to 1 (one) month. The indicated phone does not operate on a value-added tariff.
5.1.3. Orders via e-mail. The Client may submit a purchase request via e-mail to the address: eshop@medina-med.com. Such an order must contain the name and surname of the person ordering, their contact data (email address and phone), delivery address and name, quantity, and price of the ordered goods, as well as freely expressed, specific, informed, and unambiguous consent for the purposes and term of processing of the provided personal data. Besides the listed data, a tax number must additionally be submitted (this concerns solely business entities purchasing goods or individuals practicing liberal professions and serves for the correct issuance of a VAT invoice). The order will be confirmed by us via e-mail or by phone.
5.2. Upon completion of the order, the Client agrees to the "General Terms and Conditions" in their form from the day of purchase. The Client also gives consent for the use of the personal data provided by them by the Store on a contractual basis - for realizing the order, or freely expressed, specific, informed, and unambiguous consent for the purposes and term of processing of the provided personal data, for their use for marketing-advertising purposes and for the purpose of collecting opinions on the quality of services provided by the Store.
5.3. Due to the fact that in some cases a need arises to order tires from the manufacturers' warehouses, the order realization time may be extended and depends on the delivery term from the manufacturer's warehouse. In such cases, the Store will inform the Client about the estimated delivery period.
5.4. Orders are realized in the order of their receipt. Their realization depends on the request number. Therefore, we encourage you to submit requests via the Store's Internet page, which guarantees automatic issuance of a number.
5.5. In the case of a sale within a promotion and clearance, a limited quantity of goods is determined, and the realization of orders is performed in the order of submission of requests until the stocks determined for this form of sale are exhausted.
5.6. A proof of sale in the form of an invoice and warranty is issued for every order.
§6. Return of Goods:
6.1. Right of withdrawal
Every consumer has the right to withdraw from the purchased goods and, according to the Consumer Protection Act, Art. 50, may return them within 14 days from the date of receipt of the goods.
You must pay the costs of the return. The price for return with the courier company Speedy AD is in the amount of 4.81 € / 9.40 BGN incl. VAT for 1 tire for cars, vans (Bus), and 4x4 vehicles.
To exercise this right of yours, it is necessary, before the expiration of the 14-day period, to fill out and send the form attached here to:
-
by email: eshop@medina-med.com;
-
by fax to number: 02/8565203 or
-
by post to address: Stara Zagora 6000, 8 Hrishtensko Shose Str.
The entire delivery or part of it is subject to return. It is not necessary to declare the reason for the return, but for the purpose of improving the quality of service, we ask you to tell us the grounds on which you decided to return the purchased goods.
To make it easier for you, we will pick up the goods from you and refund the amount paid for them. The refund takes place within 14 days from the receipt of the goods in our warehouse. We will notify you by e-mail about the acceptance of the goods. Money is refunded in the manner in which it was received or to the bank account filled in the form.
Note: When payment is made with a bank card on a virtual POS terminal, if it is necessary to return amounts paid for the order, this will be done by the Store through a credit transaction on the card with which the payment was made. With this type of payment, other methods of refunding funds (e.g., in cash or by account) are not allowed!
When the form is filled out, we take into account two exceptions for which the right of withdrawal does not apply:
-
When the delivery concerns goods made to the Client's specification. This includes all tire deliveries that we perform according to individual requests of our Clients; and
-
When the Client is a legal entity, i.e., is not a consumer within the meaning of §13, Para. 1 of the transitional and final provisions of the Consumer Protection Act.
6.2. Consequence of withdrawal
In the event of an effective withdrawal, the goods and payments received by the parties must be returned and restored. If products cannot be returned in full or in part or are returned in poor condition, appropriate compensation should be provided for this. You can avoid the obligation to pay compensation by refraining from using the goods or performing actions that may reduce their value.
§7. Changes in Orders
7.1. The Client has the right to make changes to their order up to 2 hours after receiving confirmation of acceptance for execution of the initial order. If the change is made after this moment, the amount for returning the initially ordered goods is charged to the Client in addition to the amount for the corrected order.
For the change, please contact the Store via the contact form on the Internet page, via email at: eshop@medina-med.com or by phone at the number indicated on the Internet page.
§8. Delivery Price
8.1. The delivery of purchased goods is in the amount of 4.81 € / 9.40 BGN incl. VAT for 1 tire for cars, vans (Bus), and 4x4 vehicles for the entire territory of the country!
§9. Payment Methods
9.1. Payment for the goods may be made by the Client in the following ways:
9.1.1. Before handing over the goods to the Client:
-
Traditional Bank Transfer: After submitting the purchase request with the selected payment method "Bank Transfer", the Client receives a message via email with a pro-forma invoice. In this case, the order realization time is extended, as the Store must wait for the funds to arrive in its bank account.
-
Payment with Debit or Credit Card: When choosing this payment method, after completing the order you will be redirected to the Borica page to effect the payment. Depending on the conditions of your bank and the use of 3-D Security for safe online payments, please follow the instructions on the page for successful payment.
-

9.1.2. At the moment of receiving the goods:
-
Cash on Delivery: In this case, the Client pays the courier who delivered the goods. Proof of payment to the courier is the bill of lading accompanying the shipment.
9.2. In cases of some less popular goods or those delivered by order, www.medina-med.com reserves the right to potentially require prepayment from the Client in the amount of 30% of the value of the goods, after issuing a pro-forma invoice.
E.g.: When ordering tires from a manufacturer's warehouse that are not available at shop.medina-med.com, the Store will propose to the Client to pay 30% of the price in advance, before the delivery of the goods.
9.3. The Store may agree with the Client on other, special conditions and forms of payment. In such a case, the conditions and payment methods mentioned in the order confirmed by the Store as accepted for realization and fulfillment of all additional requirements related to the agreed conditions or payment methods (as well as payment in installments) are valid.
§10. Delivery
10.1. The goods ordered in the Store are delivered to the Client with the help of the courier company Speedy AD, to the Client's address or to a Courier office, depending on the selected option when placing the order.
10.2. The delivery time includes:
-
The time for preparing the order (completing the goods, payment method, issuing a sales document, packaging the shipment);
-
The delivery time, depending on the selected payment method.
In case of payment by bank transfer (after issuing a pro-forma invoice), the order realization period is extended, as the Store must wait for the funds to arrive in its bank account. The order execution period inscribed in the confirmation of acceptance for execution of the order by the Store is the most probable one. The final (binding) deadline for receipt is determined during the contacts of the Store employee with the Client.
Delivery times for cash on delivery and for ePay or PayPal payments do not depend on the payment method.
10.3. The delivery time of goods declared by the Courier on the territory of Bulgaria is 1 working day. In extraordinary cases of delivery to more remote addresses and small settlements, as well as when the day between confirmation and delivery is a holiday, the delivery time may be extended to 2-3 days.
10.4. The courier company delivers shipments between 9:30 and 18:00 on weekdays, and on Saturdays from 9:30 to 14:00. The Store cannot determine nor commit to an exact hour of delivery of the shipment; therefore, to establish an approximate delivery time, the courier company sends a message on the day of delivery. Providing the Client's workplace (company name) as the delivery address for the shipment guarantees delivery in the period between 9:30-17:30.
10.5. Before delivering the goods to the Client's address, the courier company sends a text message regarding the upcoming visit. In the absence of the Client from the delivery address, the courier contacts the Client and arranges a second visit or another way to hand over the shipment.
10.6. The courier's obligations do not include carrying the shipment up floors, especially for shipments with a total mass over 31 kg. In these cases, the shipment is delivered to the entrance door of the building on the ground floor.
10.7. Before making a cash payment to the courier, please check whether the delivered goods correspond to the submitted delivery request. Checking the shipment upon receipt is a mandatory condition for considering potential claims by the Client regarding violation of the integrity or quantity of the shipment during transport.
10.8. When paying in cash to a courier upon receipt of the goods, the proof of payment is the bill of lading attached to the shipment. It is also evidence of concluding a contract with the Store. The invoice is sent electronically to the client or is together with the bill of lading with the courier. According to COUNCIL DIRECTIVE 2006/112/EC of 28 November 2006 on the common system of value added tax, the VAT invoice does not need a signature or stamp.
Note: It is possible for the goods and the invoice to be delivered in separate shipments due to the fact that they depart from different addresses. If you do not receive both on the same day, please contact a shop.medina-med.com operator via email at eshop@medina-med.com or by phone at 070020707 for additional information.
10.9. The Store bears no responsibility for delays in delivery caused by the failure of courier companies to perform the transport service contract.
10.10. The Store bears no responsibility for non-delivery of goods or delay in delivery caused by incorrect or inaccurate provision of the delivery address by the Client.
§11. Warranty and Product Complaints
11.1 Medina Med Ltd. is not the manufacturer of the offered goods, but solely a trader. The warranty considered is provided on behalf of the manufacturer and at their expense. The warranty period is 24 months from the date of purchase of the goods.
11.2. Consumers have the right to file a complaint, regardless of the commercial warranty thus provided, in accordance with and under the Consumer Protection Act, whereby the seller is liable for the lack of conformity of the consumer goods with the sales contract according to the warranty under Art. 112-115 of the CPA.
11.3. The basis for considering a complaint is proof of purchase, i.e., the VAT invoice/cash receipt. When claiming goods, the Client should contact an operator serving the Store via:
-
the contact form on the internet page;
-
email at address: eshop@medina-med.com.
After you send the information, please contact the Store at phone 0700 20 707 to arrange a visit by a courier to transport the claimed tire to a shop.medina-med.com warehouse.
11.4. The warranty is provided for a period of 24 months from the date of purchase, but for no longer than the moment of tread wear, which is visible from the Tread Wear Indicator (TWI). The warranty includes solely defects due to the manufacturer's fault, i.e., factory defects. A tire worn unilaterally or partially to the TWI value is considered fully worn and is not subject to warranty.
11.5. The warranty does not cover defects caused by:
-
mechanical damage (puncture, cut);
-
improper operation;
-
improper mounting;
-
poor technical condition of the vehicle.
11.6. The deadline for considering the complaint is 30 days from the date of acceptance of the claimed goods by the Store or the courier sent at the Store's expense to transport the goods.
11.7. The complaint will be recognized in any case upon establishing a factory defect (poor workmanship, material defects, or construction defects). In case of recognition of a complaint, the Client receives goods without defects or receives monetary compensation in the amount of the funds paid for the purchased goods.
11.8. Medina Med Ltd. bears no responsibility for loss of time and inconvenience caused during the vehicle's downtime, as well as other damages representing a result of a product defect, as well as for the conducted complaint process.
11.9. You can download the text of the warranty card here.
