Terms And Conditions

These “General Terms and Conditions” define the principles for concluding sales contracts via the Online Store owned by Medina Med Ltd. (www.medina-med.com).
 
They also define the principles for the execution of contracts, the rights and obligations of the online stores and the Client, as well as the conditions of the complaint procedure. By filling in and sending a delivery request by the Client, you declare that you agree with these General Terms and Conditions, as well as that you agree that your personal data will be processed on a contractual basis – for the purposes of fulfilling each specific order, unless you have given voluntary and informed consent within the meaning of Regulation (EU) 2016/679, for its processing for other explicitly stated lawful purposes.
 
§1. Parties to the Transaction 1.1. A delivery request (order) from the Online Store can be made by any natural person who is at least 18 years old and registered with a permanent address or temporary residence in the territory of the Republic of Bulgaria, possessing full legal capacity, as well as any legal entity or organization recognized by law as having legal capacity and having its registered office in the territory of Bulgaria, hereinafter referred to as the Client.
 
1.2. The other party to the transaction is Medina Med Ltd., with registered office: Republic of Bulgaria, Stara Zagora, 8 Khrishtensko Shose St., registered in the Commercial Register, with identification number 123737210, VAT number BG123737210, hereinafter referred to as the “Online Store” or “www.medina-med.com”.
 
§2. Definitions “Product” shall mean any goods or services, including real estate, digital services, and digital content, as well as rights and obligations; “Online marketplace” means a service that, by using software, including a website, part of a website, or an application, managed by or on behalf of the trader, enables consumers to conclude distance contracts with other traders or consumers; “Website/Site” is a distinct location in the global Internet network, accessible via its unified address (URL) under the HTTP, HTTPS, or other standardized protocol, containing files, programs, text, sound, images, or other materials and resources; “Store” – Online Store operating at www.medina-med.com, owned by Medina Med Ltd., offering products available in its offer via the Internet; “Entity operating the Store” is Medina Med Ltd., which is also the owner of the online store www.medina-med.com; “Manufacturer” is any natural or legal person who, in the course of its business, manufactures finished goods. In this Store, “manufacturer” refers to any manufacturer of automotive tires, e.g., Michelin, Continental, Goodyear, Bridgestone, and their sub-brands; “Client” – a natural person who is at least 18 years old or a legal entity that makes purchases from the Store; “Consumer” is any natural person who is at least 18 years old and who acquires goods or uses services not intended for commercial or professional activities; “Sales contract” means any contract under which the trader transfers or undertakes to transfer ownership of goods to the consumer, including any contract whose subject is both goods and services; “Service contract” means any contract which is not a sales contract, under which the trader provides or undertakes to provide the consumer with a service, including a digital service; “Sale price” is the final price per unit or for a specified quantity of goods or for a service, including value-added tax and all additional taxes and charges; “Availability” – all goods listed in the online store are available in stock unless otherwise indicated for the product; “Business days” – all days of the week except officially established public holidays; “Order processing time” – the time during which the Store prepares the order and makes it available for courier dispatch, according to the delivery method chosen by the Client; “Delivery time” – the time for delivery of the goods to the Client, usually via a courier company. The delivery period depends on the delivery method chosen by the Client; “Prepayment (bank transfer)” – payment made by the Client at a bank via internet banking, in person, or by post; “Personal data” – any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to that natural person; “Processing” – any operation or set of operations performed on personal data or on sets of personal data, whether by automated means or otherwise, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment or combination, restriction, erasure, or destruction; “Restriction of processing” – marking stored personal data with the aim of limiting their processing in the future; “Profiling” – any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning the performance of their contractual relations and preferences; “Pseudonymization” – processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data are not attributed to an identified or identifiable natural person; “Personal data register” – any structured set of personal data accessible according to specific criteria, whether centralized, decentralized, or distributed on a functional or geographical basis; “Administrator” – the legal entity Medina Med Ltd., which alone or jointly with others determines the purposes and means of processing personal data; where the purposes and means of such processing are determined by Union or Member State law, the administrator or the specific criteria for its designation may be laid down by Union or Member State law; “Processor” – a natural or legal person that processes personal data on behalf of the administrator; “Recipient” – a natural or legal person, public authority, agency, or another body to which personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as “recipients”; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing; “Third party” – a natural or legal person, public authority, agency, or body other than the data subject, the administrator, the processor, and persons who, under the direct authority of the administrator or processor, are authorized to process personal data; “Consent of the data subject” – any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which they, by a statement or by a clear affirmative action, signify agreement to the processing of personal data relating to them; “Personal data breach” – a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored, or otherwise processed; “Binding corporate rules” – personal data protection policies which are adhered to by a controller or processor established in the territory of a Member State for transfers or a set of transfers of personal data to a controller or processor in one or more third countries within a group of undertakings or group of enterprises engaged in a joint economic activity; Supervisory authority for personal data – the Commission for Personal Data Protection.
 
§3. Offer
 
3.1. At www.medina-med.com we sell only new tires, not older than 36 months from the date of manufacture, unless the Client has been informed otherwise (promotions on warehouse stock, clearance sales, etc.).
 
3.2. All goods sold in the Store are NEW, free from physical and legal defects, complete, and come with a full manufacturer’s warranty for a period of 24 months.
 
3.3. According to the practice of most manufacturers, new tires are considered to be those not used and not older than 60 months from the date of manufacture. Responding to the constantly increasing demands of our customers, the Store has reduced this period to 36 months and continues to work toward further reducing it.
 
3.4. In special cases, when explicitly stated in the product name and description, in the “Sale” sub-page, “DOT Promotion”, “Promotion” or in another location determined by Medina Med Ltd., tires older than 36 months and/or tires that are out of the production process – discontinued by the manufacturer – may be offered.
 
3.5. Any information related to the goods, including leaflets, brochures, and other informational or advertising materials, as well as the information contained on the Store’s pages and addressed by Medina Med Ltd. to the Recipients and potential Clients, does not constitute an offer within the meaning of the law but is solely an invitation to begin negotiations.
 
3.6. The price list presented on the Store’s pages does not constitute a commercial offer within the meaning of the Obligations and Contracts Act but represents solely an invitation to start negotiations (Art. 13, para. 1 of the Obligations and Contracts Act).
 
§4. Prices of Goods
 
4.1. All prices published on the pages of the Medina Med Ltd. Store are indicated in Bulgarian lev (BGN) and in euro (EUR) and include VAT at 20% in accordance with Bulgarian legislation (gross prices).
 
4.2. The dual display of the prices of goods and services in euro and lev shall end no earlier than 12 months after the date of the introduction of the euro in the Republic of Bulgaria. After this date, all prices will be displayed only in euro, in accordance with the Law on the Introduction of the Euro in Bulgaria.
 
4.3. Conversion from lev to euro is carried out by dividing the numerical value in lev by the full numerical value of the official exchange rate, expressed with six digits and all five digits after the decimal point. The official exchange rate shall not be rounded or shortened when performing the conversion.
 
4.4. After the conversion, the resulting amount is rounded to the second digit after the decimal point, based on the third digit after the decimal point, in accordance with the following mathematical rounding rule: when the third digit after the decimal point is less than five, the second digit after the decimal point remains unchanged; when the third digit after the decimal point is equal to or greater than five, the second digit after the decimal point is increased by one.
 
4.5. The final price indicated for the goods is valid at the moment the purchase order is submitted by the Client.
 
4.6. The Client shall pay the delivery costs, the exact amount of which is calculated automatically by the system when creating the order. DOT Promotion – Price reduction of products from the final price, depending on the DOT code of the tire. The DOT code is a marking on the tire that contains specific information about the production of the tire, where and when it was manufactured. For the end customer, the most important information from the DOT code is the year of manufacture. These are four digits, usually enclosed in an oval, but not necessarily. The first two indicate the week of manufacture, and the next two – the year. For example, a tire with DOT NEDV JA2R 4916 was manufactured in the 49th week of 2016. (IMPORTANT! The year of manufacture is not related to the tire’s aging nor its shelf life). Promotion – Price reduction of products from the final price due to tires that are out of the production process – discontinued by the manufacturer and/or tires with a DOT code equal to and/or older than 36 months from the date of manufacture. Trade Discount – by virtue of an agreement or written contract with corporate clients and business partners and subject to the conditions specified therein, Medina Med Ltd. provides an additional trade discount from the stated final price to employees, cardholders, and other eligible persons. IMPORTANT! The stated price advantages (promotions, discounts, reductions of any kind) cannot be combined with each other, nor with other discounts, promotions, or price reductions. The most favorable price for the client applies.
 
§5. Orders 5.1. The Medina Med Ltd. Store accepts orders in three ways: via the Internet site available at www.medina-med.com, via e-mail, or by telephone. During the winter season (the months of September, October, November, and December), a telephone order may be refused due to the high workload of the operators.
 
5.1.1. Orders in the online store medina-med.com can be placed 24 hours a day, 7 days a week via the Internet site. For correct order submission, the client must have their own e-mail address and contact telephone number. This is the simplest, fastest, and most accurate way to place an order. An order for the delivery of the selected goods can be placed by adding the goods to the basket and filling out the respective registration form or quick order form without registration. The order through the Store’s website consists of the following main stages: Selection of goods from those presented on the Store’s website; Placing the selected products in the basket; Filling in a form with invoice and delivery details and the option for registration; Acceptance of the General Terms and Conditions of Sale; Giving freely expressed, specific, informed, and unambiguous consent for the purposes and duration of the processing of the provided personal data; Choosing the payment method; Final summary screen of the selected products and completed data, where the order is completed by clicking the "Confirm order" button. In response to the submitted delivery request, the store medina-med.com automatically sends by e-mail a copy of the order made by the Client. This serves as confirmation that the Client’s delivery request has been automatically assigned a number.
 
Then, within 48 hours, the Store sends a message to the Client’s provided e-mail address or contacts them in another way in order to:
 
A. confirm acceptance of the order – in this case, the sales contract is concluded on the day of confirmation;
B. refuse acceptance of the order – in this case, no contract is concluded;
C. propose a change, presenting a so-called counter-offer – in this case, the conclusion of the contract requires confirmation (approval) of the counter-offer by the Client.
 
During the winter season (increased interest in purchasing tires from September to the end of the year) and the summer season, delivery times to the client may be extended. However, with regard to the Client, the order processing time will not exceed 5 business days.
 
5.1.2. Telephone orders
 
Between 9:30 and 18:00 on business days, and between 9:30 and 14:00 on Saturdays, the Store provides its Clients with access to an operator who provides information, assistance, and accepts orders. The Client may place a purchase order by telephone. During the conversation with the consultant, the Client must provide all necessary information for the correct execution of the ordering process – the exact characteristics of the goods, full name, exact address, and contact telephone number, as well as freely expressed, specific, informed, and unambiguous consent to the processing of the provided personal data. In addition to the listed data, a tax number must also be provided (this applies only to business entities or natural persons practicing a freelance profession and is used for the correct issuance of a VAT invoice). To improve service quality and to resolve disputes between the parties, calls may be recorded. Recordings are kept for up to one (1) month. The indicated telephone number is not subject to a premium-rate tariff.
 
5.1.3. Orders via e-mail
 
The Client may also place a purchase order via e-mail at: eshop@medina-med.com. Such an order must contain the name and surname of the person ordering, their contact details (e-mail address and telephone number), delivery address, and the name, quantity, and price of the ordered goods, as well as freely expressed, specific, informed, and unambiguous consent for the purposes and duration of the processing of the provided personal data. In addition to the listed data, a tax number must also be provided (this applies only to business entities or natural persons practicing a freelance profession and is used for the correct issuance of a VAT invoice). The order will be confirmed by us via e-mail or telephone.
 
5.2. By completing the order, the Client agrees to the “General Terms and Conditions” as they are on the date of purchase. The Client also consents to the use of the personal data provided by the Store on a contractual basis – for the fulfillment of the order – or gives freely expressed, specific, informed, and unambiguous consent for the purposes and duration of processing the provided personal data, for their use for marketing and advertising purposes, and for the purpose of collecting feedback on the quality of the services provided by the Store.
 
5.3. In cases where it becomes necessary to order tires from manufacturers’ warehouses, the order fulfillment time may be extended and depends on the delivery time from the manufacturer’s warehouse. In such cases, the Store will inform the Client of the approximate delivery period.
 
5.4. Orders are processed in the order in which they are received. Their fulfillment depends on the request number. Therefore, we encourage you to place orders via the Store’s website, which ensures the automatic generation of an order number.
 
5.5. In the case of a sale as part of a promotion or clearance, a limited quantity of goods is specified, and orders are fulfilled in the order in which requests are submitted until the stocks allocated for this form of sale are exhausted. 5.6. For each order, proof of purchase in the form of an invoice and a warranty is issued.
 
§6. Return of Goods
 
6.1. Right of withdrawal Every consumer has the right to withdraw from the purchased goods and, in accordance with the Consumer Protection Act, Art. 50, may return them within 14 days from the date of receipt. You must bear the costs of returning the goods. The return fee via Speedy AD courier company is BGN 9.40 / €4.81 incl. VAT per 1 tire for passenger cars, vans, and 4x4 vehicles. To exercise this right, before the expiry of the 14-day period, you must fill in and send the form attached here to: by e-mail: eshop@medina-med.com; by fax: 02/8565203; or by post to: 6000 Stara Zagora, 8 Khrishtensko Shose St. The entire delivery or part of it may be returned. You are not required to state the reason for the return, but to help us improve our service quality, we kindly ask that you inform us of the reason you decided to return the purchased goods. To make it easier for you, we will collect the goods from you and refund the amount paid for them. The refund will be made within 14 days from the receipt of the goods in our warehouse. You will be notified by e-mail when the goods are received. The money will be refunded in the same way it was paid or to the bank account specified in the form. Note: When payment has been made by bank card via a virtual POS terminal, if a refund is required, the Store will make it via a credit transaction to the card used for the payment. For this type of payment, other refund methods (e.g., cash or bank transfer) are not allowed. At www.medina-med.com, we recognize two exceptions to the right of withdrawal, in accordance with the Consumer Protection Act: When the delivery concerns goods made to the Client’s specifications. This includes all deliveries of tires made according to the individual requests of our Clients; and When the Client is a legal entity, i.e., not a consumer within the meaning of §13, para. 1 of the Transitional and Final Provisions of the Consumer Protection Act.
 
6.2. Consequences of withdrawal In the event of a valid withdrawal, the goods and payments received by the parties must be returned and refunded. If the products cannot be returned in whole or in part or are returned in a damaged condition, appropriate compensation must be provided for this. You can avoid the obligation to pay compensation by refraining from using the goods or taking any actions that may reduce their value.
 
§7. Changes to Orders
 
7.1. The Client has the right to make changes to their order within 2 hours after receiving confirmation of acceptance for execution of the initial order. If the change is made after this time, the Client will be charged the cost for returning the initially ordered goods in addition to the cost of the adjusted order. For changes, please contact the Store via the contact form on the website, by e-mail at eshop@medina-med.com, or by telephone at the number listed on the Store’s website.
 
§8. Delivery Cost
 
8.1. The delivery cost of purchased goods is BGN 9.40 / €4.81 incl. VAT per 1 tire for passenger cars, vans, and 4x4 vehicles, for the entire territory of the country.
 
§9. Methods of Payment
 
9.1. Payment for goods can be made by the Client in the following ways:
 
9.1.1. Before the goods are handed over to the Client: Traditional bank transfer: After submitting a purchase order with the selected payment method “Bank Transfer,” the Client receives a pro forma invoice by e-mail. In this case, the order fulfillment time is extended, as the Store must wait for the funds to be credited to its bank account. Payment by debit or credit card: When selecting this payment method, after completing the order, you will be redirected to the Borica payment page to complete the payment. Depending on your bank’s conditions and the use of 3-D Secure for safe online transactions, please follow the instructions on the page for successful payment. Payment via “PB Personal Finance”: If you choose this payment method, a PB Personal Finance representative will contact you to complete a credit application and a consent declaration for the processing of your personal data, for which you can find information at the following webpage (link to PB Personal Finance personal data information). After approval, you will receive a contract that you must sign and return to PB Personal Finance. Then, Medina Med Ltd. issues an invoice to the creditor and, after receiving the funds in its account, immediately ships the goods. Installment purchase through UniCredit Consumer Financing EAD: Requirements: You must be a natural person aged 18 to 75 years at the end of the loan period. You must have a verifiable and insurable income in Bulgaria. You must have a valid identity document. Procedure – Online application Installment purchase through DSK Bank – consumer credit for goods: You choose: The size of the initial payment; The date for payment of monthly installments. Parameters: Loan term – from 3 to 48 months; Repayment method – equal monthly installments; No fee for loan approval and contract signing; No fee for early partial or full repayment; Required documents: ID card only. Application method: You can apply for installment purchase of goods and services at the retail outlets of our partners. Repayment methods: At a branch of DSK Bank; Via payment order from any commercial bank; Through online banking; Through DSK Smart; By payment at a DSK Bank ATM. 9.1.2. Upon receipt of the goods: Cash on delivery: In this case, the Client pays the courier delivering the goods. Proof of payment to the courier is the waybill accompanying the shipment.
 
9.2. In the case of some less popular goods or those delivered on order, www.medina-med.com reserves the right to require a prepayment from the Client in the amount of 30% of the value of the goods, after issuing a pro forma invoice. Example: For an order of tires from a manufacturer’s warehouse that are not available in shop.medina-med.com, the Store will offer the Client to pay 30% of the price in advance before delivery of the goods.
 
9.3. The Store may agree with the Client on other, special conditions and forms of payment. In such cases, the conditions and payment methods specified in the order confirmed by the Store as accepted for execution shall apply, along with the fulfillment of any additional requirements related to the agreed conditions or payment methods (including installment payments).
 
§10. Delivery
 
10.1. Goods ordered from the Store are delivered to the Client via the courier company Speedy AD.
 
10.2. Delivery time includes: The time for order preparation (completion of goods, payment method, issuance of proof of purchase, packaging of the shipment); The time for delivery, depending on the chosen payment method. In the case of payment by bank transfer (after issuing a pro forma invoice), the order processing time is extended as the Store must wait for the funds to be credited to its bank account. The execution time stated in the confirmation of acceptance of the order by the Store is the most probable. The final (binding) delivery date is determined during communication between the Store’s representative and the Client.
 
10.3. The courier’s declared delivery time within Bulgaria is 1 business day. In exceptional cases, for delivery to more remote addresses and small settlements, as well as when the day between confirmation and delivery is a public holiday, the delivery time may be extended to 2–3 days.
 
10.4. The courier company delivers shipments between 9:30 and 18:00 on business days and between 9:30 and 14:00 on Saturdays. The Store cannot determine or commit to an exact delivery time; therefore, to provide an approximate delivery time, the courier company sends a notification on the day of delivery. Providing your workplace (company name) as the delivery address guarantees delivery between 9:30 and 17:30.
 
10.5. Before bringing the goods to the Client’s address, the courier company sends an SMS notification about the upcoming delivery. If the Client is absent from the delivery address, the courier will contact the Client to arrange a second delivery attempt or another method of delivery.
 
10.6. The courier is not obliged to carry the shipment upstairs, especially for shipments with a total weight over 31 kg. In such cases, the shipment is delivered to the entrance door of the building at ground level.
 
10.7. Before making cash payment to the courier, please check whether the delivered goods correspond to the delivery order you placed. Checking the shipment upon receipt is a mandatory condition for reviewing any claims by the Client regarding damage or shortage of the shipment during transport.
 
10.8. When paying in cash to the courier upon receipt of the goods, proof of payment is the waybill attached to the shipment. This also serves as proof of contract with the Store. The invoice is sent to the Client by e-mail or is included with the waybill to the courier. According to Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax, the VAT invoice does not require a signature or stamp. Note: Goods and the invoice may be delivered in separate shipments because they may depart from different addresses. 10.9. The Store is not responsible for delivery delays caused by the courier companies’ non-performance under the transport service agreement.
 
10.10. The Store is not responsible for non-delivery or delayed delivery caused by incorrect or inaccurate address details provided by the Client.
 
§11. Warranty and Complaints
 
11.1. Medina Med Ltd. is not the manufacturer of the goods offered but solely a trader. The warranty provided is issued on behalf of the manufacturer and at their expense. The warranty period is 24 months from the date of purchase.
 
11.2. Consumers have the right to file a complaint, regardless of the commercial warranty provided, in accordance with and under the procedure of the Consumer Protection Act, whereby the seller is liable for the lack of conformity of the consumer goods with the sales contract under the warranty pursuant to Articles 112–115 of the Consumer Protection Act.
 
11.3. Proof of purchase, i.e., the VAT invoice/cash receipt, is the basis for processing a complaint. In the event of a complaint, the Client must contact the Store operator via: the contact form on the website; e-mail at eshop@medina-med.com. After sending the information, please contact the Store by phone at 0700 20 707 to arrange a courier pickup of the complained tire to the warehouse of shop.medina-med.com.
 
11.4. The warranty is provided for a period of 24 months from the date of purchase but for no longer than the moment the tread wears down to the tread wear indicator (TWI). The warranty covers only defects attributable to the manufacturer, i.e., factory defects. A tire that is unevenly or partially worn down to the TWI value is considered fully worn and is not covered by the warranty.
 
11.5. The warranty does not cover defects caused by: mechanical damage (puncture, cut); improper use; incorrect installation; poor technical condition of the vehicle.
 
11.6. The period for reviewing a complaint is 30 days from the date the complained goods are received by the Store or by the courier sent at the Store’s expense to transport the goods.
 
11.7. The complaint will be accepted in all cases where a manufacturing defect is established (poor workmanship, material defects, or structural defects). In the event of acceptance of a complaint, the Client will receive goods without defects or monetary compensation equal to the amount paid for the purchased goods.
 
11.8. Medina Med Ltd. is not responsible for loss of time and inconvenience caused during the vehicle’s downtime, nor for other damages resulting from a product defect or during the complaint process.

§12. Secure Shopping
 
12.1. Online Store Security shop.medina-med.com has chosen a 256-bit SSL certificate from GeoTrust to ensure the highest level of secure shopping for its customers. Additional information from GeoTrust.
 
12.2. Client payment data is transmitted over the Internet and encrypted during the ordering process. The Store has secured its website and other systems with technical and organizational measures against loss, destruction, access, alteration, and distribution of your data by unauthorized persons. In case of suspected access to confidential information, please act responsibly and close your browser window when you finish your work. After completing your session, you should log out of your user account, especially if you share your computer with others.
 
§13. Personal Data Protection

13.2. After submitting an order in the Store, the Client consents to providing their personal data to the Store’s database and to its processing for the purpose of contract execution. Providing personal data by the Client and consent to its processing is necessary for the Store to fulfill the order. The Client is responsible for providing false personal data.
 
13.3. The entrusted personal data is used solely for the performance of the contract and, after the expiration of the product warranty, will be destroyed in accordance with statutory limitation periods.
 
13.4. Personal data is not provided to other entities for marketing purposes.
 
13.5. If necessary, we may share your data with other companies, such as courier companies that will deliver your goods. These companies may use your data only for order processing, not for other purposes.
 
13.6. Through direct contact with a “data processing” specialist, the Administrator ensures the Client’s access to their personal data, including the category of personal data, recipients or categories of recipients to whom the personal data has been or will be disclosed, the intended storage period of the personal data, the existence of the right to request correction or deletion of personal data or restriction of processing, including access to the Administrator’s documentation regarding the purposes and methods for which the data has been used.

Privacy Policy The privacy policy and technical maintenance of www.medina-med.com (hereinafter referred to as “the Store”) are the responsibility of Medina Med Ltd., with registered office: Republic of Bulgaria, 6000 Stara Zagora, 8 Khrishtensko Shose St., registered in the Commercial Register, with identification number 123737210, VAT number BG123737210, hereinafter referred to as “the Owner.” \
 
The Owner collects and stores only the necessary data of persons who use the Store’s website (“Users”). At the same time, the Owner ensures that User information is not made available to third parties. This is driven by our desire to ensure that Users are confident their personal data is protected, while also complying with legal requirements.
 
As part of binding corporate rules, all employees of Medina Med Ltd. undertake not to disclose any information that becomes known to them during the performance of their job duties relating to the company’s Clients. The Owner has appointed two “data processing” specialists bound by professional secrecy.
 
Medina Med Ltd. provides Store Clients with full access to their personal data, as well as the ability to change or delete it at any time, including the right to withdraw their consent for processing, as well as the right to be “forgotten.”
 
The Store Client may delete their account or unsubscribe from e-mail communications at any time. In the site’s admin panel, the Client will find all necessary tools to manage their user profile and orders, including the ability to check their order history and related payments. Registration at www.medina-med.com requires submitting a limited amount of data and is entirely free and voluntary. Providing data is a matter of the User’s free will and informed choice. Providing incomplete or false data may result in the inability to fulfill an order.
 
The data provided during registration is processed only with the User’s permission and explicit informed consent. By filling in the data required to fulfill the order, the Buyer consents to the inclusion of their personal data in the Store’s database and to its processing by the Owner for the purpose of fulfilling the order, including verifying order-related information and providing updates on order status, as well as sending other information related to the Store and its offer, when explicit consent has been given. Providing personal data is voluntary, but refusal to do so may result in the inability to place an order.
 
When registering for the Store’s newsletter, the User consents to their address and e-mail being added to the newsletter mailing list. All e-mail addresses provided to the Owner, in accordance with data protection law, will not be shared with third parties unless you have consented. You may unsubscribe from the newsletter at any time, including withdrawing your consent for storing and processing your personal data and requesting to be “forgotten,” as easily as you gave it, via the Store’s website or by e-mail: security@medina-med.com.
 
Joining our database is intended to allow us to conduct pseudonymized marketing research, on the basis of which we can better identify User needs, leading to improved positioning of the Store and its offers. This, in turn, will increase the competence and awareness of the Store’s operator.
 
In the event of a detected security breach in the processing of personal data, the Owner provides free contact with a “data processing” specialist at: security@medina-med.com or via another convenient method for the User.
 
§16. Final Provisions
 
16.1. All product descriptions and technical data published on the Store’s pages correspond to the information provided by the manufacturer. We are not responsible for incorrect parameters and characteristics or for their sudden change by the manufacturer. The Store reserves the right to possible errors in product descriptions. Images are for illustrative purposes and serve to present the models shown. Please note that the Store sells only tires; rims are used only for product visualization. Medina Med Ltd. is not responsible for images and descriptions published for individual products.
 
16.2. Product descriptions and images are taken from the database owned by Medina Med Ltd. Any commercial use of product information extracted from the Medina Med Ltd. database is prohibited.
 
16.3. Medina Med Ltd. is not responsible for interruptions in the use of the Online Store due to technical reasons (maintenance, review, equipment replacement, etc.) or for other reasons beyond its control.
 
16.4. These General Terms and Conditions enter into force on the day of their publication on the Store’s website at www.medina-med.com and are valid indefinitely.
 
16.5. Details of activities not listed above related to the provision of services in the Store are described in other parts of the portal and constitute an integral part of the “General Terms and Conditions.”
 
16.6. Medina Med Ltd. reserves the right to amend these “General Terms and Conditions.” Any changes shall take effect from the date of their publication on the Store’s website. Orders placed before the date of changes to these “General Terms and Conditions” will be executed based on the terms that were valid on the date the order was placed.
 
16.7. For matters not regulated by these “General Terms and Conditions,” the relevant provisions of Bulgarian law and other legal acts related to the operation and functioning of the Online Store shall apply.
 
16.8. For these “General Terms and Conditions” as well as for all legal relations between Medina Med Ltd. and the Client, the Civil Procedure Code of the Republic of Bulgaria shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
